2026 Annual Spring Meeting

This session will provide general information regarding direct contact with SBA personnel for restructuring options, and will address SBA obligations in the bankruptcy context of cash collateral and plan confirmation. The panelists also will discuss bankruptcy implications for third parties, such as guarantors.

Five distinguished judges will take a stab at predicting how the circuits and the Supreme Court will decide such questions as financial distress as a requirement for bankruptcy, a newly opened bank account manufacturing venue for a mega case, bankruptcy’s immunity from arbitration, and nationwide class actions for stay violations.
