This panel of lawyers and a Delaware bankruptcy judge, who have been involved in some of the most contested recent confirmation battles, will discuss developments in the application of plan confirmation standards, as well as the latest trends in how that law is being applied at contested confirmation hearings.

In 2013, ABI launched a study of individual chapter 11 cases to determine why individual debtors choose chapter 11 and to evaluate the efficacy of individual chapter 11 cases. The study team has gathered data to identify systemic problems that increase the cost and decrease the utility of chapter 11 cases to individuals. The panel, which includes the study’s reporter, investigators and cochairs, will provide an overview of the study’s findings and recommendations.

The Worker Adjustment and Retraining Notification (WARN) Act can have a substantial impact on the administration and reorganization of a chapter 11 debtor. This panel of chapter 11 and WARN Act experts will discuss the impact that the WARN Act has in a chapter 11 bankruptcy case.

This session is a nonlegal overview of the current state of the coal and oil & gas industries and will provide a primer on terminology, extraction methods and related industries.
