Join this session for strategies for a selection of interesting topics under §§ 521, 1322 and 1325, including income issues, self-employed debtors, the means test, retirement contributions and expenses. Attendees will also learn about hot consumer issues that are of concern to judges and trustees.

The novel coronavirus has certainly induced many systemic changes around the world, and the bankruptcy and restructuring industry is no exception. What once worked in a pre-COVID-19 world might not work anymore, so parties must adapt quickly, often with no precedence upon which to rely. This panel will discuss the idiosyncrasies and novel ways bankruptcy practice is operating, restructuring and adapting to a “new normal,” and how constituencies on all sides of the table are approaching its unique aspects.

This learn-in session will prepare attorneys, particularly business bankruptcy lawyers, for dealing with insolvent pro se consumer debtors or defendants.

Presented by the Hon. Eugene R. Wedoff Seventh Circuit Consumer Bankruptcy Conference The panelists will discuss systemic/unconscious bias, defects in the system, and what the bar and the judiciary can do to correct disparate treatment.

This panel will review the basics of the Small Business Reorganization Act of 2019, as well as recent case law and issues that have cropped up since the SBRA went into effect in February 2020. Topics discussed will include an overview of subchapter V and how it differs from traditional chapter 11, qualifying corporate (and individual) debtors, debt limits pre- and post- CARES Act, the PPP and its changing role in subchapter V, the role of a subchapter V trustee, and conversion/redesignation of a case to subchapter V.

Presented by the Hon. Steven W. Rhodes Consumer Bankruptcy Conference This session will examine the high stress levels associated with the legal profession, the consequences of that stress, and what can be done about it. It draws upon recent studies to show empirically that the stress inherent in today’s legal profession is leading to higher rates of depression, anxiety and substance abuse. The studies also show that lawyers in their first 10 years of practice are at the greatest risk. To bring a personal touch to these findings, presenter Jeff Zapor will share his personal story of addiction and recovery. Stress-management techniques will then be introduced, as well as some wellness initiatives that are being tried at the national level.

Presented by NACBA This panel will focus on recent cases that have reexamined the proper application of the Brunner standard without the punitive standards, as well as cases that have distinguished and explained portions of § 523(a)(8) and why they don’t apply to all private student loans. Finally, the panelists will discuss the effect that the CARES Act has had on student loans.

The panel, featuring a judge, opposing expert witnesses and opposing counsel will present a role play type discussion on valuation testimony in bankruptcy court. The focus of the discussion will be on best practices in attacking and defending expert witness testimony and will also touch on recent pandemic issues impacting valuations.
