This panel will discuss mediation in mass-tort/multiparty cases such as Puerto Rico, Purdue, Boy Scouts andthe various religious institutions that have filed for bankruptcy. The panelists will highlight mediating tortclaims that have emotional and non-monetary components, such as sexual abuse; issues regardingnondebtor-related entity property and contributions; and liquidation concerns in a religious institutionbankruptcy.

This panel will discuss mediation as a pathway to case-resolution; mediation advantages and pitfalls; mediation privilege and disclosure; who should be invited to a mediation; and whether a sitting judge, former judge or trained mediator is the best person to lead a mediation. They will also share lessons learned from previous mediations in large cases.

This panel will examine the fraudulent transfer (and other) risks associated with a leveraged transaction, including LBOs and dividend recap transactions, and the steps that may be taken to mitigate those risks. The panelists will approach each topic with a 360-degree view, exploring the issues from the perspectives of board members, debt capital providers and equity sponsors/shareholders.

This panel will focus on current developments and trends relating to the emerging industry of cryptocurrency. The panelists will assess recent insolvencies and bankruptcy cases, and provide practitioners with tips to help navigate this evolving market. Discussion will center on such issues as whether and when digital assets may be estate assets, discovery tools and crypto-tracing, and valuation concerns.

This panel will identify recent examples of chapter 11 plans confirmed within the Ninth Circuit that contained third-party releases despite longstanding precedent in the Ninth Circuit prohibiting those releases outside of the asbestos context. The panelists also will describe the types of releases confirmed, as well as how the plan proponents were able to include the releases.

This session will discuss strategies for presenting bankruptcy issues on appeal, including procedures, briefs, oral arguments and the doctrine of mootness.

This panel will discuss pre-appeal considerations, final or interlocutory orders, stays pending appeal, perfecting an appeal, appellate briefs, and direct appeals to circuit courts.
