Plan Confirmation

This panel will explore recent developments in several Ninth Circuit Chapter 11 plan cases, from contested new value plans and interest rate valuations in the cramdown context, 1111(b) elections, designating votes, plan mootness and dealing with the reversal of plan confirmation orders, classification, and ways to maximize the value of the estate post confirmation.

The panel will discuss in depth an operating manual for Chapter 11 and a Chapter 11 Plan checklist.

The key elements to trying contested matters are planning, writing effective pleadings, knowing rules of evidence, knowing when to use expert testimony and having a strong oral argument. The techniques, among others, are discussed in this panel.

Sharing a Piece of the Pie: Gift Plans, Structured Dismissals and Carve-Outs Often bankruptcy is the best way for under-secured creditors to optimize collateral recoveries. But the price for bankruptcy relief is that secured creditors must share their recoveries with out-of-the money constituencies. This panel will explore such sharing arrangements in a variety of contexts–carve outs, gift plans and structured dismissals.

Municipalities and local government agencies have been forced to slash budgets during the recession. What can these entities do to restructure? Issues to be discussed include the reasons for municipal restructurings, eligible entities, restructuring options, state law remedies, and pension and legacy liabilities.
