
Mr. Paul J. Battista
Paul J. Battista is a partner with Venable LLP in Miami, where he focuses his practice on complex commercial bankruptcy, financial restructuring and insolvency matters, both in and out of court, including bankruptcy-related litigation and transactional work. He regularly represents chapter 11 debtors in possession (DIP), creditors? committees, DIP lenders, purchasers of assets and trustees in large and complex restructurings, workouts, and bankruptcy and insolvency proceedings in Florida and throughout the U.S. Through his representations, Mr. Battista has gained significant bankruptcy- and insolvency-related experience in numerous types of businesses, and has been involved in most of the large bankruptcy cases filed in the Southern District of Florida and statewide. He also has developed substantial experience in the representation of franchisors in numerous franchisee bankruptcies around the country, and he has experience in litigating a wide variety of bankruptcy-related claims and issues at both the trial and appellate levels, including fraud claims, Ponzi schemes, professional negligence, bankruptcy avoidance actions and collection of judgments. As a complement to his bankruptcy and creditors? rights practice, Mr. Battista has represented lenders and borrowers in all aspects of secured lending. His background includes the representation of one of the nation?s largest investment banking houses in the secondary mortgage market. Mr. Battista is admitted to practice in Florida, Rhode Island and Massachusetts, and before the U.S. Court of Appeals for the Eleventh Circuit, the U.S. District Courts for the Southern and Middle Districts of Florida, and the U.S. Supreme Court. He is a Fellow in the American College of Bankruptcy and a Chambers USA Star Individual for 2022, and he has received Lawyer of the Year honors several times in The Best Lawyers in America. He received his B.S. magna cum laude in accounting in 1983 from the University of Rhode Island and his J.D. magna cum laude in 1986 from Boston University School of Law.
