First-Day Motions

Featuring the regional judges of the Rocky Mountain Bankruptcy Conference, this session will strive to answer questions you have on current issues.Learning Objectives:Attendees will identify current issues and emerging trends in bankruptcy practice as viewed from the perspective of regional bankruptcy judges.Attendees will gain insight into judicial expectations, procedural preferences, and effective advocacy strategies in bankruptcy court.Attendees will analyze common challenges and questions arising in bankruptcy cases and how courts are addressing them in practice.

This panel will provide newer attorneys with a practical overview of first-day motions in chapter 11 cases, covering the essential relief debtors typically seek at the outset of a bankruptcy filing and offering guidance on how to effectively prepare, organize and present these critical early-case pleadings.Learning Objectives:Attendees will identify the key types of first day motions commonly filed in Chapter 11 cases and understand the relief typically sought at the outset of a bankruptcy proceeding.Attendees will evaluate best practices for preparing and organizing first day pleadings to effectively support debtor needs in the early stages of a case.Attendees will assess practical strategies for presenting first day motions in a clear and persuasive manner before the court.

This panel will consider issues related to the preparation and presentation of first-day motions, including strategies for guiding the company through the pre-filing process, efficient and timely collection of relevant data, and the presentation of necessary information to the court.

This panel will discuss practice tips during the pre-trial discovery period, as well as during the trial itself, related to the handling of evidence and objections thereto; discuss the proper use of post-judgment motions related to reconsideration and requests to amend findings of fact and conclusions of law; explain the appeals process, including motions for stay pending appeal; and explain certain important local rules, as well as updates that have occurred and those that will be coming.
